South Carolina Law Requires an Attorney to Oversee All Real Estate Closings

The South Carolina Supreme Court has determined that an attorney is required to supervise all transactions involving real estate located in South Carolina. The Court went on to state that performing a title search, preparing title and loan documents, and closing a loan without the supervision of an attorney constitutes the unauthorized practice of law. Protection for the public was the Court’s paramount concern in this decision.

Attorneys Oversee More than just the Signing of Real Estate Documents

Not only are attorneys required to oversee the actual signing of the real estate documents, they are also involved in the pre-closing and post-closing process, including:

Title: The attorney ensures the seller has a good and marketable title to the property and may have to assist in clearing up any defects, such as liens, unpaid loans, levies, administered estates and various other issues that may arise.

Documents: The attorney oversees the preparation of closing documents, including the deed, promissory note, security agreement, settlement statement and any other documents required by the lender or South Carolina state law.

Disbursements: The attorney makes sure the appropriate parties are paid before and after the closing. There are many parties in a real estate closing, including lenders, lien holders, home owners associations, taxing authorities, real estate agent and many others who are required to be paid in relation to a real estate transaction.

Recording: The attorney ensures the deed, mortgage and other relevant documents are recorded in the county in which the property is located and the recording office is paid the appropriate recording fees.
